Gregory Martin Legal Seminar - Contract Administration: Beyond Just Performing the Work
 
What: Gregory Martin of the law firm Moye, O'Brien, O'Rourke, Pickert & Martin LLP will present a complimentary legal seminar focused on Contract Administration of rail construction projects. The intent is assist contractors in the goal of claims avoidance by discussing dispute resolution alternatives such as arbitration.

Topics:
I. ACTIVE CONTRACT ADMINISTRATION
Client management, project documentation, and key contract terms. A refresher from last year's course and a discussion of key points for new attendees with a focus on the importance of making claims avoidance and claims management company priorities.

II. CHANGE ORDER AND CLAIMS MANAGEMENT
How to avoid waiving rights, but at the same time maintaining a working relationship with the client. A discussion of Change Orders and claims management, with the goal of resolution without litigation. A look at the legal issues that can be a stumbling block to resolution, or death to a claim in litigation.

III. PROJECT SCHEDULING AND DELAY CLAIMS
Focusing on the importance of project scheduling and the update process. What the owner says during the job and what it says during litigation are often different. How to supplement your project schedule updates and preserve your claims for delay.

IV. CLAIMS METHODOLOGIES - LOST PRODUCTIVITY, DELAY, AND EXTRA WORK
How to price your claims during and after the project. How to prepare yourself and your project staff to do so.

V. OPEN DISCUSSION
Closing comments, followed by a question and answer session.
